Terms and Conditions of {commercialName}

The following terms and conditions govern access to and use of the URL {publicUrl} (hereinafter WEBSITE) owned by {legalName} (hereinafter {commercialName}).

IDENTIFICATION OF THE PARTIES

On the one hand, {legalName} ({commercialName}), a limited liability company with registered office at {address}, tax identification number {vatNumber}, registered with the {registryDetails}, and email address {contactEmail}.

And, on the other hand, the individual, hereinafter USER, who accesses the website to obtain information and contract the services offered through the WEBSITE. The User declares that they are of legal age (over 18 years old) and have the necessary legal capacity to acquire the services offered through the WEBSITE and to use it according to the general conditions detailed below, which they expressly declare to understand and accept. In the event of contracting by a minor, {commercialName} will not be liable under any circumstances, and the minor, parents, or guardians must assume any expenses that this may cause.

GENERAL CONDITIONS

ACCESS TO THE WEBSITE

The WEBSITE screens support the following browsers: Chrome, Firefox, Internet Explorer 10 and 11, Safari, and Opera. {commercialName} is not responsible for the results obtained using a different browser or operating system.

USERS who access the WEBSITE using devices with small screens declare that they have previously accessed it using a device with one of the browsers indicated in the previous paragraph and have consulted the website's terms and conditions and all notices made available to the recipient without any restriction due to the characteristics of the device used to make the booking.

CONTENT AND LIABILITY

{commercialName} is a retail travel agency. As such, it may offer third-party (wholesaler) tourism products, both individual services and package tours, and/or may also create package tours for direct sale to the end customer, and not to third-party companies. {commercialName} does not create package tours for sale to third parties.

The USER is hereby informed that the contracting of package tours is governed by the provisions of Book IV of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, and by the specific conditions agreed with the USER depending on the organizer of the package tour, which may be a wholesaler, {commercialName} being a retail travel agency.

The suppliers of products or services and the organizers/wholesalers who organize the package tour, each within the scope of their respective obligations, will be responsible to the USER for compliance with the obligations arising from current regulations and the terms and conditions of sale of each of the products and services or package tours contracted, without {commercialName} assuming any obligation or liability whatsoever with respect to those products. or services that it does not provide directly, beyond the obligations that legally correspond to it when acting as a retailer.

In the event of using the website to book a tourism product, the USER is informed that the purchase of products/services through the WEBSITE implies the USER's acceptance of (i) these general conditions, (ii) the specific conditions applicable to the type of product/service to be contracted, and (iii) the conditions of the product/service provider.

The USER agrees to accept and respect the terms and conditions of purchase established by the provider of the tourism product for which the booking is made. These conditions may include the payment of any amounts due and compliance with any rules and restrictions regarding the availability of fares, products, or services, as well as the conditions for cancellation or impossibility of cancellation.

The traveler is responsible for complying with government requirements for departure, entry, and other documentation.

PURCHASE PROCESS

On the WEBSITE, reservations can be made in several languages according to the user's selection. Most fields are free-form, so the WEBSITE has no means to identify and correct errors in data entry; therefore, the USER will be responsible for any errors made when entering such data.

The document formalizing the contract by which the client acquires any tourism product or service through the WEBSITE will be sent to the USER by email. This email will contain information regarding the products and/or services contracted, your booking reference number, all payment instructions, cancellation policy, other useful information, and, if applicable, your travel documents. This document will also be archived by {commercialName}, and the USER can access it at any time through the My Bookings section of the WEBSITE, located in the upper right corner, by entering their email address and password.

The purchase of any product will only be effective when {commercialName} successfully processes the charge according to the chosen payment method. Until that time, {commercialName} may cancel the purchase.

Available payment methods are:

CREDIT OR DEBIT CARD PAYMENT.

On debit cards, the charged amount is automatically withdrawn from the associated account. On credit cards, the USER can access funds even without sufficient funds in the associated account, and the amount is typically charged at the beginning of the month following the purchase.

ONLINE TRANSFER PAYMENT. To make payments using this method, you must be an online banking customer of one of the banks that {commercialName} works with. We will connect to your bank, where you will need to log in with your username to proceed with the payment.

STANDARD BANK TRANSFER. Once you have made a reservation on our website, you must make a transfer within the next 24 business hours for the accepted amount. In the transfer details, you must include the booking reference that we will provide you upon completion of this reservation. You must send us proof of the transfer to the following email address: {contactEmail}.

PAYPAL. We will connect to PayPal, where you will need to log in with your username to proceed with the payment. We recommend payment via PayPal as it is one of the most secure payment methods. Not all of these payment options are always available; it depends on the type of product and how far in advance you make the reservation. Requesting a reservation implies a commitment from the customer to authorize the charge for the full amount of the product, service, or package tour booked. The USER agrees to accept and abide by the terms and conditions of purchase established by the supplier with whom the reservation is made. These conditions may include the payment of any amounts due and compliance with any rules and restrictions regarding the availability of rates, products, or services. Promotional prices published on the WEBSITE and in other external advertising media are generated dynamically based on automated processes and actual user searches. These prices may therefore change dynamically and randomly at any time.

The prices shown do not include local taxes, nor, where applicable, entry and/or exit fees.

RIGHT OF WITHDRAWAL

This is the user's right to cancel a contract in certain cases without having to justify their decision or assume any penalty.

Pursuant to Article 103, section l) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal will not apply to contracts relating to the supply of accommodation services for purposes other than serving as a dwelling, transport of goods, vehicle rental, food, or services related to leisure activities, if the contracts provide for a specific date or period of performance.

Regarding transport According to Article 93(k) of Royal Legislative Decree 1/2007, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users, the regulations governing distance selling (with the exception of Article 98.2) do not apply to passenger transport service contracts. Therefore, the right of withdrawal does not apply to reservations for passenger transport services. Thus, if the USER expresses their wish to cancel booked transport tickets, the cancellation conditions of the relevant company will apply.

With regard to package holidays, Article 160 of the same legal text stipulates that the USER may at any time cancel the requested or booked services, having the right to a refund of the amounts paid, but must compensate the organizer or retailer in the following amounts:

The customer will pay 100% of the booking if they cancel 30 days prior to the service start date.

If the consumer fails to appear for departure, they are obliged to pay the total amount of the trip, including any outstanding amounts, unless otherwise agreed between the parties.

If the package holiday is subject to special economic conditions, such as aircraft or ship charters or special fares, the cancellation fees will be will be established in accordance with the conditions agreed upon by the parties.

In exceptional situations of Force Majeure, the practices of date change, redeemable voucher and/or refund of amounts will be applied following current legislation and the practices applied by the rest of the tourism industry in that same or similar situation.

The USER agrees that they will contact {commercialName} through our enabled contact channels if they have any complaint before carrying out any action with their bank and before taking any legal action.

INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

The entirety of this WEBSITE: text, images, trademarks, graphics, logos, buttons, software files, color combinations, as well as the structure, selection, arrangement and presentation of its contents, is the property of {commercialName} and its reproduction, distribution, public communication and transformation are prohibited. Furthermore, the reproduction, retransmission, copying, transfer, or broadcasting, in whole or in part, of the information contained on these pages is prohibited, regardless of its purpose or the means used. Users shall use the WEBSITE solely and exclusively for private and personal use. Users may not copy, reproduce, transmit, or distribute in any way the content of this WEBSITE or the services that can be obtained through it, without the written permission of {commercialName}.

Users may not establish links to web pages of the WEBSITE without the written consent of {commercialName}.

{commercialName} will not be liable, directly or indirectly, for:

The infringement by the USER of intellectual and industrial property rights, rights to honor, personal and family privacy, and image rights (photographs), property rights, and any other rights belonging to a third party as a result of the transmission, dissemination, storage, making available, receipt, obtaining, or access to the content.

The links and hypertext that allow the USER to access services and features offered by third parties through the WEBSITE do not belong to, nor are they under the control of, {commercialName}; will not be responsible for the information contained therein nor for any effects that may arise from said information.

GENERAL INFORMATION

The portal reserves the right to modify, limit or cancel the terms and conditions applicable to the aforementioned WEBSITE. In any case, the conditions in force when the client made the reservation will apply, or subsequent conditions if these are more favorable to the consumer's interests.

{commercialName} reserves the right to deny or withdraw access to the Portal and/or the Services at any time and without prior notice to those USERS who breach these General Conditions.

These terms and conditions shall be governed by Spanish law. The courts of {jurisdiction} shall have jurisdiction over any dispute arising from these terms and conditions, except where, pursuant to Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the other party is a consumer or user, in which case the courts of the consumer's domicile shall have jurisdiction.
